Pearle* welcomes the proposal of the European Commission to create a legal framework to
ensure a Europe wide online access to cultural works for which the author(s) cannot be found. Digital technology facilitates the access to culture for a wider audience and the live performance sector benefits in various ways from online archives.
Pearle* would like to stress the importance to include both holders of copyrights and neighbouring rights in the definition of ‘work’. It is also important to include live performance organisations in the scope of the proposal, to avoid legal uncertainty on the use of orphan works by such institutions.
